Terms of Service

These terms govern your use of Consentiva, a system developed and provided by The Equation Agency, LLC, a Florida limited liability company ("we", "us"). Consentiva is a product of The Equation Agency, LLC, which is registered and operates in the State of Florida and follows Florida law. By creating an account you agree to them.

What the service does

Consentiva records radio-frequency measurements made with your receiver, compares them with baselines learnt from earlier measurements, and produces reports and evidence records. It is a measurement tool. It does not provide medical, legal or safety advice, does not identify who operates any transmitter, and a flagged "unusual" signal is not, by itself, evidence of any effect on people. Measurements depend on your hardware, settings, antenna and calibration, and the service may miss signals or report signals that have ordinary explanations.

Your responsibilities

• Laws differ from place to place, and you must follow the ones that apply to you. You are solely responsible for knowing and obeying all federal, state, local and foreign laws that apply where you are and to what you do with Consentiva, including laws on recording video and sound, privacy, publishing images of people and vehicles, trespass, drones, radio reception, and recording near schools, government or other sensitive sites. What is lawful in one state or country may be unlawful in another (for example, many places require everyone's consent to record sound, and some restrict where cameras or receivers may be used). Consentiva does not give legal advice and does not check what is lawful where you are.
• Use the service lawfully. Do not use it to harass, stalk, threaten or identify private individuals, or to accuse anyone.
• Consentiva measures signal strength. Do not use it, or anything you connect to it, to intercept, decode or listen to private communications.
• Follow the law on recording conversations, privacy and trespass, and only record where you are allowed to be.
• Consentiva only receives radio signals. Do not use your receiver to transmit unless you are licensed to.
• Video clips: record only where you are allowed to be and where people have no reasonable expectation of privacy (not into homes, bathrooms or changing areas). Sound is off unless you switch it on; Florida law requires everyone's consent to record a conversation. You are responsible for how you use and share your clips.
• Sharing: a share link is public to anyone who has it. Before you share, make sure you are comfortable with everything it shows. Do not share clips or readings that show other people's private activity, identify private individuals, or make accusations. Video clips carry your GPS position. You are responsible for what you share and for the comments you add to it. We may disable a link that breaks these terms.
• Do not present a shared page, report or survey as certified, calibrated or laboratory-grade; levels are uncalibrated unless you have entered a calibration offset, and simulator data is not a measurement.
• Keep the devices that hold your passkeys secure (screen lock on); you are responsible for activity on your account, including by phones you link to it.

Plans, trials and billing

• The Free plan records walks and can share them as public links, but keeps the analysis locked; Free recordings are deleted after 7 days unless a share link for them is on.
• Paid plans (Standard, Full and Pro) renew monthly until cancelled. Prices are shown before you subscribe. Full adds the 2.7–6 GHz range, CSV export and more linked phones; Pro adds surveys and floor plans and puts your feature requests first. Plan features can be improved or extended over time.
• We accept cards (Visa, Mastercard, American Express, Discover), Apple Pay, Google Pay, Samsung Pay, Amazon Pay, Cash App Pay and Link, processed by Stripe. The options shown at checkout can depend on your device and country. The payment method you choose is charged for every renewal until you cancel or change it under Manage billing.
• Free trials last 3 days, require a payment method, and convert to a paid subscription unless you cancel before the trial ends. One trial per customer. The free trial is how you try Consentiva before paying.
• Equipment is required and sold separately. To measure signals, Consentiva needs a compatible USB radio receiver (an RTL-SDR stick with an R820T/R820T2 tuner, or a HackRF), the right cable or adapter, and a supported phone or computer with Chrome or Edge. Your subscription does not include any hardware. We list compatible equipment at consentiva.xyz/equipment; we don't sell or ship it, and links to other stores are for convenience. Before you pay, you confirm that you understand this. Not having equipment, buying equipment that isn't compatible, or not being able to connect it is not a reason for a refund; use the free trial and the Free plan's simulator to check before you pay.
• No refunds. All payments are final and non-refundable, including the first payment after a free trial, renewals, partial months and unused time, and including payments made before you had compatible equipment. Each payment covers data that has already been received, processed, analysed and stored for you, which cannot be returned. Cancelling stops future renewals; it does not refund payments already made. This applies except where a refund is required by law.
• Before you pay, you confirm in the app and on the Stripe checkout page that you have read these Terms, including this no-refund policy, and that you understand equipment is required and sold separately. We keep a record of when you agreed, which version of the Terms you agreed to, and the IP address and browser you agreed from. After checkout we email you a summary of your plan, its price, the date of the first charge and how to cancel.
• You can cancel at any time under Manage billing; access continues until the end of the paid period.
• Chargebacks. If you believe a charge is an error, contact us at support@consentiva.xyz before disputing it with your bank, so we can look into it. If you dispute a charge, your subscription is cancelled straight away, you can't start a new one while the dispute is open, and we give the payment processor and your bank the records of your agreement to these Terms (including the no-refund policy and the equipment requirement), the emails we sent you and your use of the service, to contest the dispute.

Referral program

• Each account has a personal referral link. A person who opens it and creates a new Consentiva account within 30 days becomes your referral.
• When your referral has paid for two months of a paid plan (trial days and $0 invoices do not count), you earn one free month: a credit equal to one month of your current plan, applied automatically to your next Consentiva bill. If you are not subscribed yet, the credit is held and applied when you subscribe.
• Each referred account earns one reward. Rewards stack, have no cash value, cannot be transferred, and are not paid out on cancellation.
• Referring yourself, or accounts created to collect rewards, is not allowed. We may withhold or reverse rewards for payments that are refunded or disputed, or for abuse, and we may change or end the program for future referrals.

Your data

You own the measurements and marks you record. You give us permission to store and process them to provide the service, including using de-identified measurements to improve baselines. Our Privacy Policy explains how we handle personal information.

Availability and changes

We may change, suspend or discontinue features, and we may update these terms; continued use after an update means you accept it. We may suspend accounts that break these terms.

Your use is your responsibility

• You, not The Equation Agency, LLC, are responsible for how you use Consentiva, where you record, what you record, and everything you publish or share from your account (readings, video, share links, survey plans and anything you add to them), and for complying with the laws of the place where you use it.
• We provide the tool. We do not direct, supervise or review what members record, and we are not responsible for a member's recording, sharing or use of the service in a way that breaks the law or another person's rights.
• You agree to indemnify and hold harmless The Equation Agency, LLC, its owners and team from claims, losses and costs (including reasonable legal fees) that arise from your use of the service, your recordings or shared content, or your breach of these terms or the law.
• We may remove content, disable a share link or suspend an account if we receive a valid legal request or believe these terms or the law are being broken.

Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE EQUATION AGENCY, LLC IS NOT LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, AND OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
